We Are the Champions. . . . Again

Today April 2, 2013 – Another “TFRP” upset victory was awarded to David Selig and Bradley Dorin of Selig & Associates, Inc – successfully concluding 3 long years of pleadings, appearances and generalized angst. After taking a symbolic victory lap past the imposing IRS edifices, they enjoyed a celebratory lunch in one of New York’s priciest Steakhouses (compliments of their grateful client) before returning to their offices at 450 7th Avenue.

FYI – Understanding the Trust Fund Recovery Penalty: To encourage prompt payment of withheld income and employment taxes, including social security taxes, railroad retirement taxes, or collected excise taxes, Congress passed a law that provides for the TFRP. These taxes are called trust fund taxes because you actually hold the employee’s money in trust until you make a federal tax deposit in that amount. The TFRP may apply to you if these unpaid trust fund taxes cannot be immediately collected from the business. The business does not have to have stopped operating in order for the TFRP to be assessed.

Q. Who can be assessed the Trust Fund Recovery Penalty?

A. Anyone the IRS considers to be a “responsible person” such as:

  • An officer or an employee of a corporation,
  • A member or employee of a partnership
  • A corporate director or shareholder,
  • A member of a board of trustees of a nonprofit organization,
  • Another person with authority and control over funds to direct their disbursement,
  • Another corporation or third party payer,
  • Payroll Service Providers
  • Professional Employer Organizations
  • Responsible parties within the common law employer

Why Environmentalists’ Should Support Big Oil ?

As an environmentalist, I believe that Oil & Gas Companies deserve increased tax breaks and immunity against lawsuits and various other penalties. That’s because (whether we like it or not) Big Oil has done more to protect the environment than the EPA and every single environmental group combined. Unfortunately, to appease certain “special interest groups” the Obama Administration continues to unfairly penalize oil and gas companies. That is to say, through regulation, litigation and taxation, We the People have experienced a significant decrease in tax revenues; have suffered under a stultified economy and must endure artificially high food prices (which is the real reason so many American families are now on food stamps and public support). Moreover, oil and gas companies have developed, and are continuously developing the most efficient, safe and environmentally friendly methods of extraction and refinement. Accordingly, they should be allowed to deduct all of their operating expenses under the applicable provisions of the IRC. Regrettably “agent provocateurs” have unfairly demonized the oil industry (for their own reasons) and in doing so are hurting all of us.
